Terms & Conditions of Hire

These Terms and Conditions ("Terms") govern the hire of props ("Items") by IW Props Ltd, trading as Instaprophire ("we", "us", "our") to the customer ("you", "hirer"). By placing a booking, you agree to be bound by these Terms.

These Terms apply only to hire items and should be read alongside our Shipping & Handling Policy, which forms part of the hire agreement.

1. Definitions

  • Hire Period: The period for which the Items are hired, calculated in weekly increments unless otherwise agreed.

  • Hire Fee: The price charged for hiring the Items for the Hire Period, exclusive of VAT unless stated otherwise.

  • Replacement Value: A charge calculated as a multiple of the weekly Hire Fee, as set out in Clause 9.

  • Delivery Date: The date the Items are delivered to the address provided by you.

  • Return Due Date: The date by which the Items must be dispatched for return.

2. Basis of Hire

2.1 All Items remain our property at all times.

2.2 Hire is online-only unless otherwise agreed in writing.

2.3 Items are hired in weekly increments. Any part of a week counts as a full week unless agreed otherwise.

2.4 We reserve the right to refuse any hire at our discretion.

3. Bookings and Payment

3.1 Full payment of the Hire Fee and any required deposit must be received before Items are dispatched.

3.2 Hire prices are exclusive of delivery charges and VAT unless stated otherwise. VAT will be applied at checkout where applicable.

3.3 You are responsible for providing accurate delivery and contact details.

4. Delivery and Risk

4.1 Items are dispatched using tracked postal or courier services, as set out in our Shipping & Handling Policy.

4.2 Risk passes to you upon delivery, as confirmed by carrier tracking.

4.3 We are not responsible for delays caused by couriers once Items have been dispatched.

4.4 You must inspect Items immediately upon delivery and notify us within 24 hours of any issues. Failure to do so may result in Items being deemed accepted in good condition.

5. Use of Items

5.1 Items must be used only for their intended purpose and handled with reasonable care.

5.2 You must not:

  • Modify, alter, or attempt to repair Items

  • Sub-hire, lend, or transfer Items to any third party

  • Use Items in an illegal, unsafe, or damaging manner

5.3 Items must be kept in a safe and suitable environment at all times.

6. Care, Cleaning, and Packing

6.1 You are responsible for the care of Items during the Hire Period.

6.2 Items must be returned in the same condition as supplied, fair wear and tear excepted. Fair wear and tear does not include breakage, staining, water damage, missing parts, or misuse.

6.3 Items must be returned clean, dry, and correctly packed using the original packaging where provided.

6.4 We reserve the right to charge reasonable cleaning or re-packing fees where required.

7. Return of Items

7.1 Items must be dispatched for return no later than the Return Due Date, in accordance with our Shipping & Handling Policy.

7.2 You remain responsible for Items until they are received and checked by us, even where a prepaid return label is provided.

7.3 Late returns may incur additional hire charges at the weekly rate.

7.4 Items not returned within 7 days of the Return Due Date may be treated as lost.

8. Loss, Damage, and Missing Parts

8.1 You are fully responsible for any loss, theft, or damage during the Hire Period.

8.2 For multi-part or bulk Items, a tolerance of up to 5–10% missing components may be accepted at our discretion.

8.3 Missing parts that render an Item unusable may be treated as complete loss.

9. Charges for Loss or Damage

9.1 Charges are based on the weekly Hire Fee:

  • Partial loss or damage: up to 10× the weekly Hire Fee

  • Complete loss or irreparable damage: up to 20× the weekly Hire Fee

9.2 Repair or replacement charges are payable in addition to any hire fees, delivery charges, or other amounts already accrued under the hire.

9.3 Repair costs may be charged where applicable, up to the limits set out above.

10. Deposits

10.1 We may require a refundable deposit.

10.2 Deposits may be used to cover loss, damage, late return, cleaning, or additional charges.

10.3 Any remaining balance will be refunded within 14 days of satisfactory return and inspection.

11. Cancellations

11.1 Cancellations must be made in writing.

11.2 Cancellation fees may apply depending on timing.

11.3 No refunds are given once Items have been dispatched.

12. Limitation of Liability

12.1 We are not liable for indirect or consequential loss.

12.2 Our total liability is limited to the Hire Fee paid, except where liability cannot be excluded by law.

12.3 Nothing limits liability for death or personal injury caused by negligence.

13. Force Majeure

We are not liable for delays or failure caused by events beyond our reasonable control.

14. Governing Law

These Terms are governed by the laws of England and Wales.
